Constitution for the Auckland Chapter of the Pirate Party of New Zealand

Article 1: Name, Function and Constitution

  • 1.1 The name of this Entity will be “The Auckland Chapter of the Pirate Party of New Zealand”, which may be abbreviated “PPNZ:Ak” ("The Chapter").
  • 1.2 The function of the Chapter is to promote the goals of the Pirate Party of New Zealand ("PPNZ") within the electorates of:
    • Rodney,
    • Helensville,
    • East Coast Bays,
    • North Shore,
    • Northcote,
    • Waitakere,
    • Te Atatū,
    • New Lynn,
    • Mt Albert,
    • Mt Roskill,
    • Auckland Central,
    • Epsom,
    • Tāmaki,
    • Maungakiekie,
    • Pakuranga,
    • Botany,
    • Māngere,
    • Manukau East,
    • Manurewa,
    • Papakura,
    • Hunua.
  • 1.3 All Chapter documents, members, and policies are subject and subordinate to this constitution.

Article 2: Powers of the Executive Council of the Pirate Party of New Zealand

  • 2.1 The Chapter Committee is a subordinate body of the Executive Council of the Pirate Party of New Zealand, and as such is governed by the Pirate Party of New Zealand Constitution Article 3: Administration of the Party, Section 3, at the time of writing, or any applicable clauses in later revisions of the Pirate Party of New Zealand Constitution.

Article 3: Administration of the Chapter

  • 3.1 Unless overruled as per Article 2, administration of the Chapter will be carried out by the Chapter Committee.
  • 3.2 The Chapter Committee will make decisions by resolution.
    • An ordinary resolution of the Chapter Committee will be made by simple majority of members voting.
    • A special resolution of the Chapter Committee will be made by two-thirds majority of members voting.

Article 4: The Chapter Committee

  • 4.1 Unless overruled as per Article 2, the Chapter Committee will be comprised of those persons elected by all voting members of the Chapter.
  • 4.2 Election
    • A person is elected to the Chapter Committee as an Officer or a Committee Member.
    • An Officer will be one of the President, the Vice President, the Chapter Secretary, the Treasurer, Executive Council Representative, or an officer position created by ordinary resolution of the Chapter Committee or as per Article 2.
    • Those members that are nominated by another for a position on the Chapter Committee must consent in writing to their nomination.
    • The officer positions may not all be filled by less than three individual members of the Chapter Committee.
    • In the event a member of the Chapter Committee is unable or unwilling to perform their duties, the remaining members of the Chapter Committee may declare the position vacant and appoint an interim replacement by two-thirds majority vote of the remaining members of the Chapter Committee. As soon as possible, the members will elect a Member to fill that vacant position, unless overruled as per Article 2.
    • Each voting member is only entitled to vote once in each election.
    • Positions on the committee are conditional on elections being held no longer than 15 months after the previous elections

Article 5: Membership

  • 5.1 Membership in the Chapter is independent from membership in PPNZ.
  • 5.2 Membership is open to all persons who:
    • Reside in, or are enrolled to vote in one of the electorates listed in Article 1, Section 2, or reside in an adjacent electorate to one of the electorates listed in Article 1, Section 2;
    • Are not a member of any other regional chapter of the Pirate Party of New Zealand;
    • Submit their name and a contact detail, and agree in writing to abide by the constitution of the Chapter.
  • 5.3 Membership may also be granted to people for which Clauses 1.1 and/or 1.2 do not apply if they have been approved on record by a Chapter Committee member or a PPNZ Executive Council member.
  • 5.4 All members are entitled to:
    • Be elected into any position within the Chapter (unless Chapter elections are preempted as per Article 2);
      • With the exception of Chapter President and Executive Council Representative, which may only be filled by PPNZ members;
    • participate in issue discussion and be involved in the decision making process;
    • Vote in any poll held by the Chapter, and
    • Resign their membership in the Chapter.
  • 5.5 Membership is for a term of twelve months.

Article 6: Amendments to the Constitution and Dissolution

  • 6.1 A resolution to amend the Constitution requires a simple majority of voting members, with votes in favour of the amendment exceeding 15% of the Chapter membership. In any case, the Chapter remains a subordinate body of the Executive Council of the Pirate Party of New Zealand, as per Article 2.
  • 6.2 A resolution to amend the Constitution must be initiated by a special resolution of the Chapter Committee.
  • 6.3 The Constitution may be ammended by the PPNZ Executive Council if:
    • The Chapter Committee proposes an ammendment by special resolution, and then;
    • The PPNZ Executive Council enacts the proposal by Ordinary Resolution.
  • 6.4 The Chapter may only be dissolved by Special Resolution of the PPNZ Executive Council.
